Overview

Process Server in Czech Republic: How Service of Process Works

The Czech Republic inherited its Hague Service Convention declarations from the former Czechoslovakia, objecting to Article 8 and to Article 10 in its entirety, so postal service and private agent service are not valid. Requests go through the Czech Central Authority and are typically completed in two to four months, free of charge. A Czech translation is required for formal service. Historical supplementary agreements with Germany and Slovakia predate the EU's own Service Regulation, which now governs relations among EU member states but does not apply to U.S.-originated requests.

Who serves process

Who Can Serve Legal Documents in the Czech Republic

The Czech Republic is a civil-law country, and service is governed by the Civil Procedure Code and carried out through the courts. The Central Authority is the Ministry of Justice in Prague.

The Czech Republic kept the former Czechoslovakia's declarations, objecting to every Article 10 method and to consular service, so the Central Authority is the only valid route. Documents need a Czech translation, and service is generally free of charge.

For defendants in Prague or elsewhere in the Czech Republic, the usual starting point is a statement of claim with a summons to appear; orders, notices and enforcement papers follow later in a case. Addresses range from Prague to Moravia & Silesia.

Proof you receive: certificate or sworn affidavit

The Czech court records the service, and the Hague Certificate of Service is returned for filing with your court.

01

Central Authority Filing

We prepare and submit the Hague request, together with a certified Czech translation, to the Czech Central Authority for execution and issuance of the Article 6 certificate.

02

Certified Czech Translation

Formal service requires the document to be translated into Czech. We prepare complete, compliant translation packages to keep filings on the typical two-to-four-month timeline.

03

No-Cost Filing Support

The Czech Republic charges no government fee for executing a service request, one of the more cost-efficient Central Authority jurisdictions to work with.

Treaties

Hague Service Convention and Czech Republic

The Czech Republic is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. The Czech Republic has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.

The Czech Republic is also a party to the Hague Evidence Convention, so witness testimony and documents can be requested with a Letter of Request.

FAQs

Process Server Czech Republic: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

Can I serve a Czech defendant by mail or private agent?

No. The Czech Republic objected to Article 10 in its entirety, inherited from the former Czechoslovakia's declarations, so postal service and private agent service are not valid.

Is translation required?

Yes. Formal service requires a Czech translation of the document to be served.

How long does service take?

Generally two to four months from receipt by the Central Authority.

Is there a fee for Central Authority service?

No. Service of documents is generally free of charge, with no special costs under Article 12.

Do older bilateral agreements with Germany and Slovakia still apply?

Historically yes, but the EU Service Regulation now takes precedence in relations between the Czech Republic and those EU member states — this does not affect U.S.-originated requests, which continue under the Hague Service Convention.
