Overview

Process Server in Montenegro: How Service of Process Works

Montenegro acceded to the Hague Service Convention on January 16, 2012, with entry into force on September 1, 2012. Montenegro's declarations touch Articles 8, 10, and 15, so requests are generally directed through the formal Central Authority rather than the Article 10 alternatives. Documents are translated into Montenegrin for formal service.

Who serves process

Who Can Serve Legal Documents in Montenegro

Montenegro is a civil-law country. The Central Authority is the Ministry of Justice, Human and Minority Rights in Podgorica, and requests are executed by the Basic Courts under the Law on Civil Procedure.

Montenegro has entered reservations on every Article 10 method, so the Central Authority is the reliable route. Translation into the official language is obligatory. There are no costs, and no fixed time limit for execution.

The documents most often bound for Podgorica and the rest of Montenegro are a statement of claim with a summons to appear, plus orders, subpoenas and other court notices. Defendants may be anywhere from Podgorica to Remaining Municipalities, and we cover the whole country.

Proof you receive: certificate or sworn affidavit

The Basic Court records the service, and the Hague Certificate of Service is returned for filing with your court.

01

Central Authority Filing

We prepare and submit the Hague request to Montenegro's Central Authority for execution through the Montenegrin court system.

02

Certified Montenegrin Translation

We prepare certified Montenegrin translations for documents processed through the Central Authority.

03

Regional Coordination

For matters spanning the former Yugoslav republics, we coordinate filings across Montenegro, Serbia, Croatia, Bosnia and Herzegovina, and North Macedonia, each with its own distinct declarations.

Treaties

Hague Service Convention and Montenegro

Montenegro is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. Montenegro has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.

Montenegro is also a party to the Hague Evidence Convention, so witness testimony and documents can be requested with a Letter of Request.

FAQs

Process Server Montenegro: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

When did Montenegro join the Hague Service Convention?

Montenegro acceded on January 16, 2012, with the Convention entering into force domestically on September 1, 2012.

Can documents be served in Montenegro by mail or private agent?

Generally no. Montenegro objects to postal and private service under Article 10, so U.S. requests for Podgorica must go through its Central Authority.

Is translation required?

Yes, into Montenegrin, for documents processed through the Central Authority.

Who is Montenegro's Central Authority?

A designated Ministry of Justice authority in Podgorica coordinates incoming Hague Service Convention requests.

How does Montenegro's approach compare to its regional neighbors?

Broadly similar to Serbia and Croatia, though each former Yugoslav republic filed its own distinct declarations, so procedures should be confirmed per country.
