Overview

Process Server in Maine: How Service of Process Works

Maine lets plaintiffs start with a simple option: under Maine Rule of Civil Procedure 4(c)(1), the summons and complaint can be mailed with an acknowledgment form, and service is complete once the defendant signs and returns it. If that doesn't work, a sheriff or deputy, or another person authorized by law or appointed by the court, serves in hand or at the defendant's dwelling with a person of suitable age and discretion. A Maine action can start by serving the complaint, in which case it must then be filed within 20 days.

Who may serve

Who Can Serve Legal Papers in Maine

Under Maine Rule 4(c), service can be made by mail with acknowledgment, or in person by a sheriff or deputy, or another person authorized by law or specially appointed by the court. Maine doesn't license private process servers.

Because an action can be commenced by service, a summons may be served before the complaint is filed with the court.

Typical documents include summonses and complaints, small claims papers, forcible entry and detainer (eviction) papers, subpoenas and family matters.

Proof you receive

A sheriff files a return; another authorized person files an affidavit of service. For mail service, the signed acknowledgment is the proof.

Can't find your answer? Call 855-505-9155.

How are papers served in Maine?

Often first by mail with an acknowledgment form; if the defendant doesn't return it, a sheriff, deputy or other authorized person serves in hand or at the defendant's dwelling.

Can someone else at my house accept papers for me in Maine?

Yes. Papers can be left at your dwelling with a person of suitable age and discretion who lives there.

I was served in Maine. How long do I have to answer?

Generally 20 days after service. The summons states the deadline; a lawyer licensed in Maine can confirm it.

How much does a process server cost in Maine?

There's no single Maine price: a routine service in Augusta costs less than a rush job or a hard-to-find defendant in Northern Maine. Sheriff fees apply to in-person service. We confirm the exact price before any work begins.
