Overview

Process Server in Maryland: How Service of Process Works

Maryland doesn't license process servers: under Rule 2-123, the sheriff or any competent private person who is at least 18 and not a party to the case may serve. Rule 2-121 gives three standard methods, including certified mail marked 'Restricted Delivery', and a summons goes dormant if it isn't served within 60 days of being issued. If a defendant evades service, the court can order alternatives.

Who may serve

Who Can Serve Legal Papers in Maryland

Under Maryland Rule 2-123, service may be made by the sheriff or by any competent private person who is at least 18 and not a party to the action. Maryland has no licensing requirement for private process servers.

Companies are usually served through their resident agent, whose details are listed with the Maryland State Department of Assessments and Taxation (SDAT). If no resident agent exists or a good-faith attempt to serve one fails, Rule 2-124 allows other methods.

Typical documents include writs of summons and complaints, District Court papers, family law complaints, subpoenas and landlord-tenant papers.

Proof you receive

The private server files an affidavit of service stating the date, place and manner of service and that they are at least 18 and not a party. For certified mail, the signed return receipt is attached.

Good to know

Serving Court Papers in Maryland: What to Know

Watch the 60-day summons

Under Rule 2-113, a summons not served within 60 days becomes dormant; ask the clerk to reissue it rather than serving an expired summons.

Restricted delivery matters

Certified mail counts only if it's sent 'Restricted Delivery' to the defendant; an ordinary certified letter signed by someone else won't do.

Find the resident agent

Check SDAT's business records for a company's resident agent before serving; leaving papers with an unauthorized receptionist can make service invalid.

Evasion has a remedy

If a defendant is avoiding service, an affidavit describing the attempts lets the court order mail plus workplace delivery under Rule 2-121(b).

FAQs

Process Server Maryland: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

What are the requirements for a process server in Maryland?

Under Rule 2-123, any competent person who is at least 18 and not a party to the case can serve process, along with the sheriff. Maryland doesn't require a license for private process servers.

What are the rules for service of process in Maryland?

Rule 2-121 allows personal delivery, leaving the papers at the home with a resident of suitable age and discretion, or certified mail marked 'Restricted Delivery'. The summons must be served within 60 days of being issued, and the server files an affidavit of service.

What if I don't answer the door to a process server in Maryland?

It won't stop the case. The papers can be left with another adult resident, sent by restricted-delivery certified mail, or, if you're found to be evading service, served by a court-ordered method such as mail plus delivery at your workplace.

What can process servers legally do in Maryland?

They can deliver papers in person, leave them with a suitable adult at your home, and record their attempts. They can't trespass, use force, threaten you or pretend to be law enforcement.

How much does it cost to serve papers in Maryland?

In Maryland, cost turns on location, urgency, attempts and any skip tracing; serving in Annapolis usually costs less than reaching Southern & Western Maryland. The sheriff charges a set fee listed on the Maryland Judiciary website, and private servers set their own prices based on location, urgency and attempts. We quote a fixed price upfront.

I was served in Maryland. How long do I have to respond?

In circuit court, generally 30 days after being served, and longer if you were served outside Maryland. District Court cases follow their own notice. Read the summons carefully and speak to a lawyer promptly.
