Overview

Process Server in New Mexico: How Service of Process Works

In New Mexico, any person 18 or older who isn't a party can serve process under Rule 1-004 of the New Mexico Rules of Civil Procedure. Personal delivery comes first. If the defendant can't be served personally, papers can be left at their usual place of abode with someone 15 or older who lives there, with a copy mailed to the defendant. If no one qualified is there, papers can be posted at the most public part of the home, again with a mailing.
