Overview

Process Server in Austria: How Service of Process Works

Austria ratified the Hague Service Convention in 2020 (in force from September 12, 2020) and has objected to Article 8 and Article 10 in full, closing off postal service, direct judicial-officer service, and interested-person service from abroad. Requests are routed through the Federal Ministry of Justice in Vienna, Austria's Central Authority, which forwards them to the competent Bezirksgericht (district court) for execution. A certified German translation must accompany every request. Separately, Austria has reserved the position that the Convention does not apply to service of documents addressed to the Austrian state itself, its political subdivisions, or persons acting on its behalf.

Who serves process

Who Can Serve Legal Documents in Austria

Austria is a civil-law country. The Central Authority is the Federal Ministry of Justice in Vienna, which sends requests to the competent district court (Bezirksgericht). The courts serve documents by post under Austria's Service of Documents Act (Zustellgesetz), or by any method the requesting court asks for that Austrian law allows.

Austria objects to every Article 10 method and to service by foreign diplomats or consuls on non-nationals, so the Central Authority is the only route. Formal service only happens if documents are in German or translated into German; otherwise service depends on the person accepting the papers.

Most papers we serve in Austria, whether in Vienna or the regions, are a Klage (statement of claim), followed by court orders, injunctions and judgment notices. We serve in Vienna, across Eastern Austria and out to Western Austria.

Proof you receive: certificate or sworn affidavit

The Austrian court records the service and issues the Hague Certificate of Service.

01

Federal Ministry of Justice Central Authority Filing

We prepare and submit the Hague request to Austria's Federal Ministry of Justice in Vienna, which forwards it to the competent Bezirksgericht (district court) for execution and issuance of the Article 6 certificate.

02

Certified German Translation

Austria's Central Authority will only arrange formal service if the document is in German or accompanied by a German translation. Certified German translations are prepared for the full set of papers before they go to Austria, whether to Vienna or Western Austria.

03

Service on Austrian State Entities

Austria has reserved that the Convention doesn't apply to documents addressed to the Austrian state, its subdivisions, or its authorities — we advise on the correct alternative approach for these matters.

Treaties

Hague Service Convention and Austria

Austria is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. Austria has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.

Austria is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.

FAQs

Process Server Austria: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

Can I serve an Austrian defendant by mail or private agent?

No. Austria has objected to Article 10 in its entirety, so postal service, direct judicial-officer service, and interested-person service from abroad are all invalid. The Federal Ministry of Justice Central Authority is the only route.

Is translation required?

Yes. Austria's Central Authority will only arrange formal service if the document is written in German or accompanied by a German translation.

Who is Austria's Central Authority?

The Federal Ministry of Justice (Bundesministerium für Justiz), based in Vienna, which forwards requests to the competent Bezirksgericht (district court).

Can the Austrian government itself be served this way?

No. Austria has reserved that the Hague Service Convention does not apply to documents addressed to the Republic of Austria, its political subdivisions, or persons acting on its behalf — a separate approach is needed for those matters.

How long does service take in Austria?

Austria reports execution 'as swift as possible, depending on the specific case,' without a fixed standard timeline.
