Overview

Process Server in California: How Service of Process Works

California lets any adult who isn't a party to the case serve a summons, but anyone who serves more than 10 papers a year for pay must be a registered process server. That registration matters: under Evidence Code section 647, a registered server's declaration of service is presumed valid, which makes defaults far harder to set aside. Plaintiffs must also move quickly, because the California Rules of Court give you 60 days from filing the complaint to serve every defendant and file proof of service.

Who serves process

Who Can Serve Legal Documents in California

Under Code of Civil Procedure section 414.10, any person who is at least 18 and not a party to the action may serve a summons and complaint. The plaintiff can't serve it personally.

Anyone who makes more than 10 services of process a year for compensation must register as a process server with the county clerk where they live or do business, under Business and Professions Code section 22350, and carry a registration ID card. A registered server's declaration of service is presumed valid under Evidence Code section 647, which is the main reason attorneys use one.

Typical documents include summonses and complaints, subpoenas, small claims papers, family law petitions, unlawful detainer (eviction) papers and restraining orders.

Proof you receive: a sworn affidavit of service

The server completes a proof of service, usually on Judicial Council form POS-010, signed under penalty of perjury. For substituted service, it includes a declaration of the diligent attempts made first.

Personal service by a California registered process server, with a declaration of service that carries the Evidence Code 647 presumption of validity.

02

Substituted service with diligence records

Documented attempts at different times and days, then substituted service under CCP 415.20 with the mailing and declaration your court expects.

03

Skip tracing before service

Locate searches when a California address is out of date, so attempts don't burn time against the 60-day deadline.

Treaties

California and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. California has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on California's law and on what your court allows.

California is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.

Good to know

Serving Court Papers in California: What to Know

The 60-day clock

California Rules of Court rule 3.110(b) requires service and the filing of proof within 60 days of filing the complaint. Courts can extend it, but ask before the deadline passes.

"Reasonable diligence" is being defined

Assembly Bill 747, signed in October 2025, defines reasonable diligence as at least three attempts at personal delivery, on three different days at three different times, once its changes take effect.

Serving companies

Check the California Secretary of State's business search for a company's registered agent for service of process before attempting service.

Why use a registered server

Their declaration of service is presumed valid under Evidence Code section 647, which helps if the defendant later challenges a default.

Watch for fake "process server" calls

Real process servers deliver papers; they don't collect money or threaten arrest by phone. If a caller asks for payment, check the case with the court directly.

FAQs

Process Server California: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

Who can serve papers in California?

Any adult who is not a party to the case can serve a summons under CCP 414.10. Anyone who serves more than 10 papers a year for pay must be registered with the county clerk as a process server.

How long do I have to serve a California lawsuit?

Under California Rules of Court rule 3.110(b), you must serve every defendant and file proof of service within 60 days of filing the complaint, unless the court extends the time.

What is service of process in California?

It's the formal delivery of court papers, such as a summons and complaint, so the person being sued has legal notice of the case. In California, a summons must be served by an adult who isn't a party to the case, using a method the Code of Civil Procedure allows, and then proven with a signed proof of service.

How do you serve someone in California who is avoiding service?

After reasonable diligence at personal service, California allows substituted service under CCP 415.20: leaving the papers with a competent adult at the person's home or with the person in charge at their business, then mailing a copy. If the person still can't be found, the court can order service by publication under CCP 415.50.

How much does a process server cost in California?

There's no single California price: a routine service in Sacramento costs less than a rush job or a hard-to-find defendant in Southern California. We confirm the exact price before any work begins.

I was served in California. How long do I have to respond?

For most civil lawsuits, a defendant has 30 calendar days after service to file a written response with the court. Eviction (unlawful detainer) cases have a much shorter deadline, so read the summons carefully and speak to a lawyer promptly.

Can a process server call me?

Yes. A process server may call or text to arrange a time to deliver papers. A real process server won't demand payment or threaten arrest; calls that do are a common scam, so verify the case number with the court directly.

When is substituted service allowed in California?

After personal service can't be made with reasonable diligence. The papers are left with a competent adult at the defendant's home, or the person in charge at their office, and a copy is mailed. Service is complete 10 days after mailing.

What is a registered process server, and why does it matter?

A server registered with the county clerk under Business and Professions Code section 22350. Their declaration of service is presumed valid under Evidence Code section 647, which makes it harder for a defendant to challenge service.

Can papers be served by mail in California?

Yes, by notice and acknowledgment under CCP 415.30, but service only counts once the defendant signs and returns the acknowledgment form. If they don't, you need another method.
