Overview

Process Server in Hawaii: How Service of Process Works

Hawaii controls who may serve process. Besides sheriffs and deputies, private process servers must be on the list of authorized civil process servers kept by the state's law enforcement department, and getting on the list requires a recommendation letter from a Hawaii attorney or a current authorized server. Under the Hawaii Rules of Civil Procedure, papers can be delivered personally or left at the defendant's dwelling with a person of suitable age and discretion who lives there.

Who serves process

Who Can Serve Legal Documents in Hawaii

In Hawaii, process is served by sheriffs and deputies or by private process servers authorized by the state's law enforcement department, which keeps the list of authorized civil process servers.

To be added to the list, an applicant submits a letter from a Hawaii State Bar attorney or a current authorized process server recommending them and confirming their training in the types of process they'll serve.

Typical documents include summonses and complaints, district court papers, landlord-tenant papers, subpoenas and family court papers.

Proof you receive: a sworn affidavit of service

The server files a return or affidavit of service stating how, when and where service was made.

Treaties

Hawaii and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Hawaii has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Hawaii's law and on what your court allows.

Hawaii is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
