Overview

Process Server in Kentucky: How Service of Process Works

Kentucky's default method of service is certified or registered mail sent by the circuit clerk, marked for delivery to the addressee only, and it's complete only on delivery. Under CR 4.01, the plaintiff can instead have the summons delivered to the sheriff, or ask the clerk to return it so a private process server or constable can serve it. Kentucky doesn't license process servers. Its rule for individuals centers on personal delivery, so we confirm how residence service would be treated before relying on it.

Who serves process

Who Can Serve Legal Documents in Kentucky

Under CR 4.01, the clerk serves by registered or certified mail restricted to the addressee unless the plaintiff directs otherwise. The plaintiff can have the summons sent to the sheriff, or have it returned for service by another authorized person, such as a private process server or constable, whose endorsed return is proof of service.

Kentucky has no statewide license, bond or registration for process servers. For service on an individual outside Kentucky, any person over 18 can deliver the papers, with an affidavit of service.

Typical documents include summonses and complaints, forcible detainer (eviction) papers, small claims papers, subpoenas and divorce petitions.

Proof you receive: a sworn affidavit of service

For mail service, the return receipt filed by the clerk is the proof. A sheriff, constable or private server endorses a return stating how, when and where service was made.

Treaties

Kentucky and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Kentucky has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Kentucky's law and on what your court allows.

Kentucky is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.

Good to know

Serving Court Papers in Kentucky: What to Know

Mail first, by default

Unless you say otherwise, the clerk serves by certified mail; if it comes back undelivered, ask for sheriff or private service.

Delivery, not mailing

Certified mail service is complete only when the envelope is actually delivered to the addressee.

Private service is your choice

Under CR 4.01(1)(c), the clerk can return the summons so you can use a private process server or constable.

Employers can refuse entry

Kentucky's rules say a company doesn't have to let a server into its plant or shop to serve an employee, so plan another location.
