Overview

Process Server in Montana: How Service of Process Works

Montana requires registration for frequent servers: anyone who makes more than 10 services of process in a calendar year must be registered as a process server under state law, unless they're a sheriff, constable, other government employee acting in their job, or a licensed attorney. A registered process server can serve anywhere in Montana and can also act as a levying officer. Under the Montana Rules of Civil Procedure, papers can be delivered personally or left at the defendant's dwelling with a person of suitable age and discretion.

Who serves process

Who Can Serve Legal Documents in Montana

Under Montana Code § 25-1-1101, a person who makes more than 10 services of process in Montana during a calendar year must be registered as a process server. Sheriffs, constables, coroners, other government employees acting in their job, and licensed attorneys are exempt.

Only registered process servers may use the title 'process server'. A registered server may serve process in any county and may act as a levying officer.

Typical documents include summonses and complaints, justice court papers, eviction papers, subpoenas and writs of execution.

Proof you receive: a sworn affidavit of service

The server signs a return or affidavit of service; a registered server includes their registration information.

Treaties

Montana and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Montana has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Montana's law and on what your court allows.

Montana is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
