Overview

Process Server in Nicaragua: How Service of Process Works

Nicaragua acceded to the Hague Service Convention on July 24, 2019, with entry into force on February 1, 2020. Nicaragua's Central Authority is the Ministry of Foreign Affairs (Ministerio de Relaciones Exteriores), which is somewhat distinctive since many Latin American jurisdictions covered on this site route Hague requests through a Ministry of Justice instead. Nicaragua has not objected to Article 10(a), so postal service by registered mail with return receipt requested is a valid alternative to the full Central Authority process.

Who serves process

Who Can Serve Legal Documents in Nicaragua

Nicaragua is a civil-law country. The Hague Service Convention has been in force since 2020, and the Central Authority is the Secretariat of the Supreme Court of Justice in Managua, which sends requests to the competent court for service and returns the completed documents.

The request form and every document must be translated into Spanish, and service is free of charge. Nicaragua's Hague listing doesn't state a position on postal or agent service, so we confirm before relying on those methods. Some Nicaraguan officials and entities are subject to U.S. sanctions, so check them if relevant.

For defendants in Managua or elsewhere in Nicaragua, the usual starting point is a demanda (complaint) with its citación or emplazamiento (summons); orders, notices and enforcement papers follow later in a case. Defendants may be anywhere from Managua to Caribbean & River San Juan, and we cover the whole country.

Proof you receive: certificate or sworn affidavit

The Nicaraguan court completes the service, and the Supreme Court Secretariat returns the Hague Certificate of Service.

01

Postal Channel Service (Article 10(a))

Since Nicaragua has not objected to Article 10(a), registered mail service with a return receipt is a valid, often faster alternative to the formal Central Authority route.

02

Ministry of Foreign Affairs Central Authority Filing

We submit requests to Nicaragua's Ministry of Foreign Affairs, coordinating execution through the local court system or a bailiff (oficial notificador).

03

Certified Spanish Translation

Documents must be translated into Spanish when served through the Central Authority. We arrange certified Spanish translations of every document so the courts in Managua accept them.

Treaties

Hague Service Convention and Nicaragua

Nicaragua is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. We check its declarations on postal and direct service before choosing a method.

Nicaragua is also a party to the Hague Evidence Convention, so witness testimony and documents can be requested with a Letter of Request.
