Overview

Process Server in Panama: How Service of Process Works

Because Panama is outside the Hague Service Convention, papers for Panama City can't be sent through a Central Authority. As a member of the Organization of American States, Panama participates in the Inter-American Convention on Letters Rogatory (IACAP), providing a more structured regional alternative for judicial cooperation with the United States than traditional diplomatic Letters Rogatory. Panama's civil-law system, while distinct from the common-law framework once used in the former Panama Canal Zone, retains commercial ties and familiarity with U.S. legal practice given the countries' long economic relationship.

Who serves process

Who Can Serve Legal Documents in Panama

Panama is a civil-law country, and court documents are served through the courts by court officials.

Because Panama is outside the Hague Service Convention, papers for Panama City can't be sent through a Central Authority. It is a party to the Inter-American Convention on Letters Rogatory and its Additional Protocol with the United States, with its designated authority as its Central Authority. A local agent in Panama City is a valid alternative, because the Inter-American Convention isn't exclusive; local-law compliance still matters for enforcement in Panama.

The documents most often bound for Panama City and the rest of Panama are a demanda (complaint) with its citación or emplazamiento (summons), plus orders, subpoenas and other court notices. Defendants may be anywhere from Panama City to Eastern Panama & Indigenous Comarcas, and we cover the whole country.

Proof you receive: a sworn affidavit of service

After delivery in Panama City or elsewhere in Panama, you receive a sworn affidavit of service from the person who served, with an English translation if it is issued in Spanish.

01

Inter-American Convention (IACAP) Service

For suitable cases we file under the Inter-American Convention, so the request reaches Panama's courts in Panama City through Central Authorities.

02

Local Agent Service via Panamanian Counsel

We engage local Panamanian counsel to advise on the fastest compliant method for a given matter under Panamanian civil procedure.

03

Certified Spanish Translation

Documents intended for use in Panamanian proceedings generally require Spanish translation. Certified Spanish translations are prepared for the full set of papers before they go to Panama, whether to Panama City or Eastern Panama & Indigenous Comarcas.

Treaties

Panama and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Panama has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Panama's law and on what your court allows.

Panama is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory. Panama and the United States are both parties to the Inter-American Convention on Letters Rogatory and its Additional Protocol, which offers another formal route.

FAQs

Process Server Panama: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

Is Panama a signatory to the Hague Service Convention?

No. Panama uses the Inter-American Convention and Additional Protocol with the U.S. instead, which gives a structured route to the courts in Panama City.

Is translation required?

Yes, generally into Spanish, for documents used in Panamanian proceedings.

Does Panama's history with the Panama Canal Zone affect its legal system?

Panama's national legal system is civil law, distinct from the common-law framework once used within the former Canal Zone, though the countries maintain substantial commercial and legal familiarity given their long relationship.

What happens if IACAP doesn't apply to a particular case?

If a treaty route isn't suitable, a traditional letter rogatory can still reach Panama City through diplomatic channels, though it is slower.

Is Panama a significant hub for international business litigation?

Yes. Panama's role as a major shipping, logistics, and offshore financial center means it frequently comes up in cross-border commercial disputes despite its non-Hague status.
