Overview

Process Server in Singapore: How Service of Process Works

Singapore is one of the newest major economies to join the Hague Service Convention, acceding on May 16, 2023, with the Convention entering into force on December 1, 2023. Notably, Singapore lodged a full objection to Article 10, closing off postal service and private agent service, even though Singapore's own common-law tradition had long permitted parties to agree on service by post domestically. This makes Singapore's position stricter than many other common-law jurisdictions covered on this site, such as the UK or Australia — every request must now be channeled through the Ministry of Law's Central Authority.

Who serves process

Who Can Serve Legal Documents in Singapore

Singapore has a common-law legal system, and court documents are served by process servers of the courts or by solicitors' agents under the Rules of Court 2021. The Hague Service Convention has been in force for Singapore since December 1, 2023.

The Central Authority is the International Legal Division of the Ministry of Law. Judicial documents are served through the Registrar of the Supreme Court, who also signs the Certificate of Service. Singapore objects to every Article 10 method, so postal service and private agents from abroad are not valid. Requests should be in English, and Singapore can ask to be reimbursed for the cost of its process server.

Typical documents include originating claims and applications, court orders and notices.

Proof you receive: certificate or sworn affidavit

The Registrar of the Supreme Court completes the Hague Certificate of Service, which can be sent back by email if the request was sent by email.

01

Ministry of Law Central Authority Filing

We prepare and submit the Hague request to Singapore's Ministry of Law, International Legal Division, which coordinates with the Registrar of the Supreme Court for execution.

02

Compliant Documentation for a New Regime

Since Singapore's Hague framework only took effect in December 2023, we stay current on Central Authority practice and processing patterns as they develop under this still-maturing regime.

03

English-Language Filing Support

As an English-language jurisdiction, Singapore filings typically avoid the translation costs and delays common in many other Hague jurisdictions.

Treaties

Hague Service Convention and Singapore

Singapore is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. Singapore has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.

Singapore is also a party to the Hague Evidence Convention, so witness testimony and documents can be requested with a Letter of Request.

FAQs

Process Server Singapore: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

When did Singapore join the Hague Service Convention?

Singapore acceded on May 16, 2023, with the Convention entering into force domestically on December 1, 2023 — one of the most recent major-economy accessions.

Can I serve a Singapore defendant by mail or private agent?

No. Despite Singapore's common-law tradition, which had long allowed parties to agree on postal service, Singapore lodged a full objection to Article 10 upon acceding, so service must now go through the Central Authority.

Who is Singapore's Central Authority?

The Ministry of Law, International Legal Division, with the Registrar of the Supreme Court designated as the Competent Authority under Article 6.

Is translation required for Singapore filings?

English is an official language of Singapore's courts, so English-language filings from the U.S. typically don't require the certified translation many other Hague jurisdictions demand.

Why did Singapore object to Article 10 if it's a common-law country?

Legal commentators have noted this is somewhat unusual, since Singapore's own domestic rules had permitted postal service by agreement; Singapore's choice makes its inbound service regime stricter than several other common-law Hague signatories.
