Overview

Process Server in Wyoming: How Service of Process Works

In Wyoming, a summons can be served by the sheriff or by any person 18 or older who isn't a party, under Rule 4 of the Wyoming Rules of Civil Procedure. Papers can be delivered personally or left at the defendant's usual place of abode with a person 14 or older who lives there. Wyoming doesn't license process servers.

Who serves process

Who Can Serve Legal Documents in Wyoming

Under Wyoming Rule of Civil Procedure 4, process may be served by the sheriff or by any person who is at least 18 and not a party. Wyoming doesn't license process servers.

Wyoming's long distances between towns can affect how quickly service is completed.

Typical documents include summonses and complaints, circuit court papers, eviction (forcible entry and detainer) papers, subpoenas and divorce papers.

Proof you receive: a sworn affidavit of service

The server signs an affidavit or return of service stating how, when and where service was made.

Wyoming and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Wyoming has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Wyoming's law and on what your court allows.

Wyoming is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
