Overview

Process Server in Sri Lanka: How Service of Process Works

Sri Lanka is a Hague Service Convention signatory with an unusual mix of declarations: it objected to Article 8, 10(a), and 10(c), but lodged no objection to Article 10(b), meaning direct service through Sri Lankan District Court Judges acting as competent persons is valid, alongside the formal Central Authority route through the Secretary to the Ministry of Justice in Colombo. Sri Lanka accepts requests in English, Sinhala, or Tamil, and charges no government fee. Sri Lankan authorities have also invoked Article 13 to reject a Hague request on sovereignty grounds in a high-profile case involving the country's own president.

Who serves process

Who Can Serve Legal Documents in Sri Lanka

A mixed legal system applies in Sri Lanka, but procedure in Colombo's courts follows common-law lines. The Central Authority is the Secretary to the Ministry of Justice in Colombo, who sends requests to the District Court for service under Section 50 of the Civil Procedure Code.

Sri Lanka objects to postal service under Article 10(a) and to service by interested persons under 10(c), but not to service through competent judicial officers under 10(b); its Hague listing names District Court Judges. Documents may be in English, Sinhala or Tamil. Sri Lanka charges no fee, and the Hague Conference lists two to four months.

For defendants in Colombo or elsewhere in Sri Lanka, the usual starting point is a claim form or writ of summons with the statement of claim; orders, notices and enforcement papers follow later in a case. Defendants may be anywhere from Colombo to the North Western, North Central & Uva Provinces, and we cover the whole country.

Proof you receive: certificate or sworn affidavit

The District Court records the service, and the Hague Certificate of Service is returned for filing with your court.

01

Ministry of Justice Central Authority Filing

We submit the Hague request to the Secretary to the Ministry of Justice in Colombo, which forwards it to the relevant District Judge for execution under Section 50 of Sri Lanka's Civil Procedure Code.

02

Direct Service via District Court Judges (Article 10(b))

Since Sri Lanka has not objected to Article 10(b), direct service through District Court Judges acting as competent persons is a valid alternative to the full Central Authority process.

03

Multi-Language Filing Support

Sri Lanka accepts requests in English, Sinhala, or Tamil. We prepare filings in the language that best fits the case and the defendant's location.

FAQs

Process Server Sri Lanka: Frequently Asked Questions

Can't find your answer? Call 855-505-9155.

Can I serve a Sri Lankan defendant by mail?

No. Sri Lanka objected to Article 10(a), so postal channel service from abroad is not valid.

Can a judicial officer serve documents directly in Sri Lanka?

Yes, uniquely among many jurisdictions covered here. Sri Lanka has not objected to Article 10(b), so direct service through District Court Judges acting as competent persons is valid alongside the Central Authority route.

Is there a cost for Central Authority service in Sri Lanka?

No. The Government of Sri Lanka charges no fee for executing service requests.

What languages are accepted for filings?

English, Sinhala, or Tamil — all are accepted by Sri Lanka's Central Authority.

Can Sri Lanka reject a Hague request?

Yes, on limited grounds. Sri Lanka's Ministry of Justice has publicly invoked the Convention's sovereignty and security exception to decline service in at least one high-profile case, so requests touching sensitive government matters should anticipate this possibility.
