Overview
Process Server in Palau: How Service of Process Works
Palau is not a party to the Hague Service Convention — its only Hague Conference instrument to date is the separate 1961 Apostille Convention, joined in 2020. Like Micronesia and the Marshall Islands, Palau has a Compact of Free Association with the United States, giving it an unusually close relationship and a legal system significantly influenced by U.S. law. Cross-border service typically relies on local-agent service or diplomatic channels.
Who serves process
Who Can Serve Legal Documents in Palau
Palau has a common-law legal system strongly influenced by U.S. law, and its Rules of Civil Procedure are modelled on the U.S. Federal Rules. Documents are normally served personally, and the court can allow other methods when personal service isn't possible.
Because Palau is outside the Hague Service Convention, papers for Ngerulmud can't be sent through a Central Authority. Most U.S. litigants use a local agent in Palau, quickest in and around Ngerulmud; letters rogatory through diplomatic channels are the formal alternative. Where enforcement in Palau is likely, we favor a method the courts in Ngerulmud would recognize, even if a faster one would satisfy your U.S. court. English is used in Palau's courts, from Ngerulmud to the Southern & Outer States, so U.S. papers can usually be served without translation. For authenticating documents, Palau accepts apostilles as a party to the Apostille Convention, which saves an embassy step for papers bound for Ngerulmud.
Most papers we serve in Palau, whether in Ngerulmud or the regions, are a claim form or writ of summons with the statement of claim, followed by court orders, injunctions and judgment notices. We serve in Ngerulmud, across Koror & Airai States and out to the Southern & Outer States.

Treaties
Palau and the Hague Conventions: Treaty Status
The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Palau has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Palau's law and on what your court allows.
Palau is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
