Overview

Process Server in Tanzania: How Service of Process Works

There is no Hague Service Convention route into Tanzania; requests for Dodoma or Southern Zone need another channel. As a Commonwealth common-law jurisdiction, Tanzania's High Court civil procedure rules permit personal service, service by a registered court process server, or service through local counsel, with formal Letters Rogatory available as a treaty-independent fallback. English and Swahili are both used in Tanzanian legal practice, with English predominating in higher courts and formal filings.

Who serves process

Who Can Serve Legal Documents in Tanzania

Tanzania has a common-law legal system. Service of summons is governed by Order V of the Civil Procedure Code (Cap. 33), amended in 2019, and carried out by court process servers, who must be registered under the Court Brokers and Process Servers Regulations, 2017. Personal service comes first, and courts can order substituted service, including electronic means, when the defendant can't be found.

There is no Hague Service Convention route into Tanzania; requests for Dodoma or Southern Zone need another channel. Most U.S. litigants use a local agent in Tanzania, quickest in and around Dodoma; letters rogatory through diplomatic channels are the formal alternative. If you may later enforce a judgment in Tanzania, for example against assets in Dodoma, the method should also satisfy local law. English and Swahili are both used in the courts, so English documents are generally accepted.

For defendants in Dodoma or elsewhere in Tanzania, the usual starting point is a claim form or writ of summons with the statement of claim; orders, notices and enforcement papers follow later in a case. Addresses range from Dodoma to Southern Zone.

Proof you receive: a sworn affidavit of service

The process server swears an affidavit of service, which Tanzanian courts examine closely.

Treaties

Tanzania and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Tanzania has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Tanzania's law and on what your court allows.

Tanzania is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
