Overview
Process Server in Kuwait: How Service of Process Works
Kuwait has objected to Article 8 and Article 10 in their entirety, so postal service and private agent service are not valid. Requests are routed through the Ministry of Justice's International Relations Department in Kuwait City, Kuwait's Central Authority, which forwards them to the competent authorities for execution. Kuwait reports one of the faster processing timelines among the jurisdictions covered here — typically under two months — with no government fee. Two copies of a certified Arabic translation are required, though the addressee may optionally accept an untranslated document.
Who serves process
Who Can Serve Legal Documents in Kuwait
Kuwait is a civil-law country. The Central Authority is the International Relations Department of the Ministry of Justice in Kuwait City, which sends requests to the competent authorities for service.
Because Kuwait has objected to all Article 10 methods, service in Kuwait City or Ahmadi & Jahra has to go through the Central Authority. It requires two copies of the documents translated into Arabic; untranslated documents can only be delivered to someone who accepts them voluntarily.
Most papers we serve in Kuwait, whether in Kuwait City or the regions, are an Arabic-language statement of claim, followed by court orders, injunctions and judgment notices. Addresses range from Kuwait City to Ahmadi & Jahra.
Proof you receive: certificate or sworn affidavit
The Kuwaiti authority records the service, and the Hague Certificate of Service is returned for filing with your court.
Ministry of Justice Central Authority Filing
We prepare and submit the Hague request to Kuwait's Ministry of Justice, International Relations Department, tracking the filing through Kuwait's typically fast processing timeline.
Certified Arabic Translation (Two Copies)
Kuwait requires two copies of a certified Arabic translation of judicial documents. We prepare compliant translation packages to keep filings on track.
Regional Treaty Awareness
Kuwait is also party to the multilateral Gulf Cooperation Council judicial cooperation convention and several bilateral agreements — we account for these where relevant to a case's broader Gulf-region strategy.
Treaties
Hague Service Convention and Kuwait
Kuwait is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. Kuwait has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.
Kuwait is also a party to the Hague Evidence Convention, so witness testimony and documents can be requested with a Letter of Request.
