Overview
Process Server in Mozambique: How Service of Process Works
Mozambique sits outside the Hague Service Convention, so U.S. litigants serve in Maputo and elsewhere through local agents or formal letters rogatory. Mozambique's legal system reflects its Portuguese colonial history, following a civil-law tradition, with Portuguese as the official language of government and the courts, notwithstanding Mozambique's otherwise close regional ties to English-speaking Southern African neighbors.
Who serves process
Who Can Serve Legal Documents in Mozambique
Service in Mozambique follows national procedure under a civil-law system, with the main courts in Maputo. Court documents are served by court officers (oficiais de justiça).
Mozambique has not joined the Hague Service Convention, so there is no Central Authority route for U.S. papers going to Maputo. Papers from a U.S. court usually reach the person through a local agent, often within weeks in Maputo; letters rogatory take longer but carry the authority of both courts. If you may later enforce a judgment in Mozambique, for example against assets in Maputo, the method should also satisfy local law. Portuguese is the official language, so documents need Portuguese translations. Security conditions in Cabo Delgado province can limit service there.
For defendants in Maputo or elsewhere in Mozambique, the usual starting point is a petição inicial (initial claim) with a citação (summons); orders, notices and enforcement papers follow later in a case. We serve in Maputo, across Southern Mozambique and out to Northern Mozambique.
Proof you receive: a sworn affidavit of service
Once the papers are served in Maputo or elsewhere in Mozambique, the court officer provides the court's record of service or a sworn affidavit if a local agent serves instead, with an English translation if it is issued in Portuguese.
Diplomatic Letters Rogatory
We prepare and route formal Letters Rogatory through diplomatic channels to Mozambican judicial authorities, the standard pathway for U.S.-originated requests.
Local Agent Service via Mozambican Counsel
We engage local Mozambican counsel to advise on the fastest compliant method given Mozambique's non-Hague status and Portuguese-influenced civil-law procedure.
Certified Portuguese Translation
Formal filings intended for Mozambican courts require Portuguese translation. Every page is translated into Portuguese by certified legal translators, ready for service in Maputo and the rest of Mozambique.
Treaties
Mozambique and the Hague Conventions: Treaty Status
The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Mozambique has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Mozambique's law and on what your court allows.
Mozambique is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
