Overview
Process Server in Oklahoma: How Service of Process Works
Oklahoma limits who may serve a summons. Under 12 O.S. § 2004(C), the plaintiff can choose the sheriff or a deputy, a person licensed to serve process in civil cases, or a person the court specially appoints. Papers can be left at the defendant's home with a resident aged 15 or older, and service by certified mail must be restricted to the addressee. A defendant must be served within 180 days of filing, or the claim against them can be dismissed.
Who may serve
Who Can Serve Legal Papers in Oklahoma
Under 12 O.S. § 2004(C)(1), process other than a subpoena is served, at the plaintiff's election, by a sheriff or deputy, a person licensed to make service of process in civil cases, or a person specially appointed for that purpose.
Oklahoma licenses private process servers through the courts. Someone who isn't a sheriff, deputy or licensed server must make an affidavit of service.
Typical documents include summonses and petitions, small claims affidavits, forcible entry and detainer (eviction) papers, subpoenas and protective orders.
Proof you receive
A licensed server or sheriff files a return of service; anyone else makes an affidavit stating how, when and where service was made.
