Overview

Process Server in Indiana: How Service of Process Works

Indiana gives plaintiffs several ways to serve. Under Trial Rule 4.1, a summons can be sent by certified or registered mail to the defendant's home or workplace, delivered personally, or left at the defendant's dwelling or usual place of abode, in which case a copy must also be sent by first-class mail. Personal and home service are normally made by the sheriff or a person specially or regularly appointed by the court under Trial Rule 4.12, though service by anyone else is still effective if they prove it as a witness.

Who may serve

Who Can Serve Legal Papers in Indiana

Trial Rule 4.12 says personal and home service are made by the sheriff, a deputy, or a person specially or regularly appointed by the court. Service by someone else is still effective, but they must prove it as a witness or by deposition, and their costs can't be recovered. Indiana doesn't license process servers.

Certified or registered mail can be sent by the clerk or a person not a party who is at least 18. The person serving must act promptly and with reasonable care.

Typical documents include summonses and complaints, small claims notices, eviction papers, subpoenas and dissolution papers.

Proof you receive

The return shows how, when and where service was made and, for home or agent service, that the first-class mailing was sent. For mail service, the return receipt is the proof.

Good to know

Serving Court Papers in Indiana: What to Know

Leave and mail

Home service in Indiana doesn't require handing the papers to anyone, but a copy must also be sent by first-class mail and noted on the return.

Appointment saves testimony

Personal service by an unappointed private server is still effective, but they may have to testify to prove it, so a court appointment is simpler.

Workplace mail works

Certified mail can go to the defendant's place of business or employment, not just their home.

Rule updated in 2026
