Overview

Process Server in Nebraska: How Service of Process Works

Nebraska offers three main methods under Neb. Rev. Stat. § 25-505.01: personal service, residence service, and certified mail service. Residence service means leaving the summons at the defendant's usual place of residence and mailing a copy by first-class mail. Certified mail service is sent by the plaintiff's attorney, with return receipt requested. A defendant should be served within 180 days of filing, or the action can be dismissed.

Who may serve

Who Can Serve Legal Papers in Nebraska

In Nebraska, summonses are served by the sheriff or by another person authorized under Nebraska law, and certified mail service can be made by the plaintiff's attorney. Nebraska doesn't license private process servers statewide.

Because Nebraska's age of majority is 19, we use servers who meet that age requirement.

Typical documents include summonses and complaints, county court papers, eviction papers, subpoenas and dissolution papers.

Proof you receive

The server files a return of service; for certified mail, the signed return receipt is filed with an affidavit.
