Process Server in Azerbaijan: How Service of Process Works
Azerbaijan is one of the newest parties to the Hague Service Convention, acceding on February 17, 2023, with the Convention entering into force domestically on September 1, 2023. Because the accession is so recent, Azerbaijani courts have not yet developed case law addressing questions such as whether the Convention operates as a mandatory or merely permissive framework in domestic proceedings — questions that are well-settled in longer-standing Hague jurisdictions like the United States following Volkswagenwerk v. Schlunk. Litigants should confirm current Central Authority practice directly and build extra time into their timeline.
Who serves process
Who Can Serve Legal Documents in Azerbaijan
Azerbaijan is a civil-law country, and the Hague Service Convention has been in force since September 1, 2023. The Central Authority is the Ministry of Justice in Baku, and formal service is carried out by the courts under the Code of Civil Procedure.
Because Azerbaijan has objected to all Article 10 methods, service in Baku or the Remaining Economic Regions has to go through the Central Authority. Documents are only accepted in Azerbaijani or with a certified Azerbaijani translation. Service is free unless a special method is requested, and takes about three to six months.
Most papers we serve in Azerbaijan, whether in Baku or the regions, are a statement of claim with a summons to appear, followed by court orders, injunctions and judgment notices. Defendants may be anywhere from Baku to the Remaining Economic Regions, and we cover the whole country.
Proof you receive: certificate or sworn affidavit
The Azerbaijani court that served the documents completes the Hague Certificate of Service.
Central Authority Filing (New Regime)
Our team drafts the Hague request for Azerbaijan, files it with the Central Authority and follows it through to service in Baku.
Certified Azerbaijani or Russian Translation
We prepare certified translations into Azerbaijani or Russian as appropriate for the specific filing.
Realistic Timeline Guidance
With the Convention only recently in force for Azerbaijan, timelines for Baku are estimated conservatively.
Treaties
Hague Service Convention and Azerbaijan
Azerbaijan is a party to the Hague Service Convention, so documents can be sent to its Central Authority, which arranges service and returns a Certificate of Service. Azerbaijan has made a declaration on Article 10, which limits service by post or by private agents, so we confirm which methods are open before choosing one.
Azerbaijan is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
