Process Server in Cambodia: How Service of Process Works
With no Hague Service Convention route into Cambodia, service from the United States, whether to Phnom Penh or Eastern Cambodia, uses a local agent or letters rogatory. Cambodia's legal system follows a civil-law tradition, rebuilt substantially after the Khmer Rouge era with significant French and, more recently, international donor influence, and Khmer is the official language.
Who serves process
Who Can Serve Legal Documents in Cambodia
Cambodia is a civil-law country, and service is governed by the Code of Civil Procedure of 2006, which was drafted with Japanese assistance. Court documents are served through the courts, often by court clerks or by post.
There is no Hague Service Convention route into Cambodia; requests for Phnom Penh or Eastern Cambodia need another channel. For a U.S. case, a local agent who hands the papers over in person, in Phnom Penh or out in Eastern Cambodia, is usually fastest; letters rogatory suit cases needing a court-to-court request. Service that ignores Cambodia's own rules can weaken a judgment you later try to enforce in Phnom Penh's courts, so we match the method to your next step. Khmer is the official language of the courts, so documents need Khmer translations.
The documents most often bound for Phnom Penh and the rest of Cambodia are a statement of claim with a summons to appear, plus orders, subpoenas and other court notices. Defendants may be anywhere from Phnom Penh to Eastern Cambodia, and we cover the whole country.
Proof you receive: a sworn affidavit of service
Once the papers are served in Phnom Penh or elsewhere in Cambodia, the court provides the court's record of service or a sworn affidavit if a local agent serves instead, with an English translation if it is issued in Khmer.
Diplomatic Letters Rogatory
We prepare and route formal Letters Rogatory through diplomatic channels to Cambodian judicial authorities, the standard pathway for U.S.-originated requests.
Local Agent Service via Cambodian Counsel
We engage local Cambodian counsel to advise on the fastest compliant method given Cambodia's non-Hague status and civil-law procedure.
Certified Khmer Translation
Formal filings intended for Cambodian courts require Khmer translation. Every page is translated into Khmer by certified legal translators, ready for service in Phnom Penh and the rest of Cambodia.
Treaties
Cambodia and the Hague Conventions: Treaty Status
The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Cambodia has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Cambodia's law and on what your court allows.
Cambodia is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
