Overview

Process Server in Senegal: How Service of Process Works

With no Hague Service Convention route into Senegal, service from the United States, whether to Dakar or Southern & Eastern Senegal, uses a local agent or letters rogatory. Senegal is a member of OHADA (the Organization for the Harmonization of Business Law in Africa), which unifies certain areas of commercial law across 17 West and Central African member states, though this framework addresses substantive business law rather than cross-border service of process specifically. Senegal's legal system carries strong French civil-law influence.

Who serves process

Who Can Serve Legal Documents in Senegal

Senegal is a civil-law country, and court documents are served by a bailiff (huissier de justice) under the Code of Civil Procedure.

Senegal has not joined the Hague Service Convention, so there is no Central Authority route for U.S. papers going to Dakar. For a U.S. case, a local agent who hands the papers over in person, in Dakar or out in Southern & Eastern Senegal, is usually fastest; letters rogatory suit cases needing a court-to-court request. If you may later enforce a judgment in Senegal, for example against assets in Dakar, the method should also satisfy local law. French is the official language, so documents need French translations. Senegal joined the Apostille Convention in 2023.

The documents most often bound for Dakar and the rest of Senegal are an assignation (writ of summons) or a requête (application), plus orders, subpoenas and other court notices. Defendants may be anywhere from Dakar to Southern & Eastern Senegal, and we cover the whole country.

Proof you receive: a sworn affidavit of service

The bailiff prepares an official record (exploit) of service.

01

Diplomatic Letters Rogatory

We prepare and route formal Letters Rogatory through diplomatic channels to Senegalese judicial authorities, the standard pathway for U.S.-originated requests.

02

Local Agent Service via Senegalese Counsel

We engage local Senegalese counsel to advise on the fastest compliant method given Senegal's non-Hague status and French-influenced civil-law procedure.

03

Certified French Translation

Documents need French translations to be served formally in Senegal, whether in Dakar or Southern & Eastern Senegal. We arrange certified French translations of every document so the courts in Dakar accept them.

Treaties

Senegal and the Hague Conventions: Treaty Status

The Hague Service Convention lets member countries send documents to each other's Central Authorities for service. Senegal has not joined it, so that route isn't available, and the Convention's Article 10 rules on postal and private service don't apply. Whether those methods are acceptable depends on Senegal's law and on what your court allows.

Senegal is not a party to the Hague Evidence Convention, so requests for witness testimony or documents go through letters rogatory.
